Terms of Service

These Terms of Service ("Terms") are an agreement between you and EZ AI Automation, a service operated by Second Source MKT, Bangladesh ("EZ AI Automation", "we", "us") and govern your use of ezaiautomation.com and our AI sales and support assistant platform (the "Services"). By creating a workspace or using the Services you agree to these Terms and to our Privacy Policy. If you accept on behalf of a company, you confirm you have authority to bind it.

1. The Services

We provide software that lets a business ("you") run an AI assistant that talks to your customers on your website chat, Facebook Messenger and Instagram, tracks leads, and can use your catalog and knowledge base to answer questions. Features depend on your plan and on what we have enabled for your workspace.

2. Your account

• You must give accurate information and keep your sign-in details secure. You are responsible for activity in your workspace, including by your team members.
• Tell us promptly if you suspect unauthorized access.
• You must be old enough to form a binding contract where you live.

3. Plans, trials and payment

• Paid plans are billed in advance each month through Stripe. Prices are shown on our website and in your dashboard. You authorize us to charge your payment method.
• A free trial, where offered, ends on the date shown. If you do not choose a plan, your workspace is paused when the trial ends.
• If a payment fails or your subscription ends, your workspace is paused: the AI stops replying and new conversations are turned away, while you can still sign in and see your data. Paying again restores it.
• Each plan has usage limits, such as a number of conversations per month. We may turn away new conversations once a limit is reached.
• You can cancel at any time from the billing page in your dashboard. Cancellation takes effect as shown there. Fees already paid are not refunded unless the law requires it or we say otherwise at purchase.
• We may change prices with advance notice; changes apply from your next billing period.

4. Acceptable use

You agree not to use the Services to:

• break the law or infringe anyone's rights;
• send spam, or message people who have not contacted you or have asked you to stop;
• mislead people, impersonate others, or hide that a customer is talking to an automated assistant when they ask;
• collect sensitive data such as card numbers, passwords or government IDs through chat;
• attempt to break, overload or gain unauthorized access to the Services or other workspaces.

If you connect Facebook or Instagram, you must also follow Meta's Platform Terms, Messenger and Instagram policies, and the messaging-window rules they set. You are responsible for having the right to message your customers.

5. Your content and your customers' data

You keep ownership of the content you provide and of your conversations. You give us permission to process them to provide the Services (including sending relevant text to our AI provider to write replies), as described in the Privacy Policy. You are responsible for the information you put in your catalog and knowledge base, and for having the right to use it.

6. AI-generated replies

The assistant is automated and can make mistakes. It is not a substitute for professional advice. You are responsible for reviewing how your assistant behaves, for the business information you give it, and for following up on conversations that need a person. We do not guarantee sales, leads or any particular result.

7. Third-party services

The Services rely on third parties such as Meta, Google, Stripe and email providers. Their availability and terms are outside our control, and a change or outage on their side may affect the Services.

8. Availability and changes

We work to keep the Services running but do not promise uninterrupted or error-free service. We may improve, change or remove features, and will give notice of significant changes where we reasonably can.

9. Suspension and termination

You may stop using the Services and delete your account at any time (see Data Deletion). We may suspend or end access if you breach these Terms, if payment is not made, if required by law or by a platform such as Meta, or if your use risks harm to others or to the Services. On deletion, your workspace data is permanently removed as described in the Privacy Policy.

10. Disclaimers and limits of liability

The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, and we are not liable for indirect or consequential losses, lost profits or lost business, or for losses caused by third-party services. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to these Terms

We may update these Terms. We will notify you of material changes by email or in the dashboard. Continuing to use the Services after a change means you accept it.
